Ensuring clarity: Mutation process in Bangladesh land management

In various online social media handles, misinformation circulates claiming the abandonment of the Mutation process, causing confusion among many. It is crucial to clarify that, under the current land management system in Bangladesh, there is no provision to discard the Mutation process.

Section 143 (c) of ‘The State Acquisition and Tenancy Act, 1950’ outlines the procedure for rectification of the Record of Rights, emphasizing the necessity of mutation for co-sharers of the holding. Sections 8, 9, and 23 of the Tenancy Rules, 1955 also explicitly reference the mutation process.

To enhance convenience and alleviate challenges faced by the public, the government has undertaken initiatives to streamline the mutation process. Provisions have been established for automatic mutation through the “Registration-Mutation Interconnection” after land registration, signifying any change in land ownership.

The Prime Minister inaugurated the automatic Mutation process through the Registration-Mutation interconnection on March 29, 2023, currently operational in 17 upazilas. Plans are underway for nationwide implementation of the Registration-Mutation interconnection.

It is imperative to understand that Mutation signifies a change in land ownership details. The process involves updating records after correcting government documents following registration completion or acquiring land ownership through valid means.

Upon the successful completion of an individual’s mutation, they receive a Record of Rights (ROR/Records/Khatiyan), providing a concise account statement of their acquired land. This correction mechanism through Mutation plays a crucial role in validating land ownership, forming a fundamental condition for proving land ownership according to government records.
